Document Overview
The Punjab Apartment and Property Regulation Act, 1995 (PAPRA) is Punjab's pre-RERA framework for regulating private real estate promoters. It governs the promotion, construction, sale and transfer of apartments, plots and colonies, and mandates registration of promoters and estate agents before they can market or sell property in the state — the same registration regime referenced in GMADA's Developer Services pages for licensed colonies and NOC-not-required listings.
Key Provisions & Structure
The Act is organised into four chapters:
- Chapter I — Preliminary: definitions of "advertisement," "allottee," "apartment," "promoter," "estate agent" and similar terms that recur across GMADA's colony and plot documentation.
- Chapter II — Regulation of Promotion of Construction, Sale, Transfer: disclosure obligations before sale (title, plans, approvals), the content required in agreements to sell, and promoters' obligation to hand over documents and possession as agreed.
- Chapter III — Registration of Promoters and Estate Agents: the licensing mechanism a developer must complete before dealing in plots or apartments — the legal basis for the "Licensed Colonies" and "NOC not required for registry" lists published by GMADA.
- Chapter IV — Miscellaneous Provisions: offences, penalties, and the rule-making power exercised via the companion Punjab Apartment and Property Regulation Rules, 1995.
