Document Overview
These regulations set out the disciplinary framework for Authority employees — the penalties that can be imposed for misconduct, and the procedure that must be followed before imposing them.
Key Provisions & Structure
Penalties are split into two tiers:
- Minor penalties: censure; withholding of promotion; recovery from pay of any pecuniary loss caused by negligence or breach of trust; withholding of increments without cumulative effect.
- Major penalties: withholding of increments with cumulative effect, or reduction to a lower pay stage (with directions on whether future increments are affected); reduction to a lower time-scale, grade or post, ordinarily barring promotion back to the original grade.
Before a minor penalty can be imposed, the employee must be informed in writing of the proposed action and the allegations against them, given a chance to respond, and — where the punishing authority considers it necessary — subjected to a formal enquiry under Regulation 12, with the final order recording reasons.
