GMADA Public Notice
Policy for allotment of SCO/Clustered SCOs at Aerocity, SAS Nagar through E-Auction.
Overview of the SCO/Clustered SCO Allotment Policy at Aerocity
GMADA has issued a policy for allotment of SCO and Clustered SCO sites at Aerocity, S.A.S. Nagar through e-auction. The policy explains who can participate, how much money a successful bidder has to pay, when possession is given, what happens if payments are delayed, and how the sites can be used or transferred. The policy applies to commercial sites being offered in Commercial Pocket 1 and Commercial Pocket 2 of Aerocity.
What Types of Sites Are Being Offered?
The policy covers two types of commercial properties. An SCO site has an area of 500 sq. yds. with an FAR of 1:4. A Clustered SCO is formed by joining four SCO sites, giving a total area of 2,000 sq. yds. with an FAR of 1:4. The clustered site can later be subdivided into 2, 3 or 4 smaller SCOs, but each smaller SCO must be at least 500 sq. yds. GMADA has clarified that a Clustered SCO is treated as a single site and is not to be considered the same as a Chunk Site.
How Much Eligibility Fee Is Required?
Before participating in the e-auction, the intending bidder has to deposit a refundable/adjustable eligibility fee online. The minimum eligibility fee is:
- SCO: ₹25 lakh
- Clustered SCO: ₹1 crore
The detailed advertisement and e-auction documents will contain the applicable site-wise information.
What Happens When You Win the Auction?
Winning the highest bid does not mean the entire amount has to be paid immediately. The successful bidder first has to deposit 10% of the total bid amount, after adjusting the eligibility fee already paid online. An additional 2% Cancer Cess on the total bid amount is also payable. This payment has to be made within 5 working days from the date GMADA communicates acceptance of the bid through SMS or email. If the required amount is not deposited within the given period, the eligibility fee can be forfeited.
What Happens After the Allotment Letter?
GMADA will issue the allotment letter within 30 days of the required 10% payment plus 2% Cancer Cess. After receiving the allotment letter, the successful bidder has to deposit another 15% of the total bid price within 7 working days, taking the total payment to 25%. If this 15% payment is not made within the specified period, GMADA will treat it as non-acceptance of the allotment and the amount already deposited, including Cancer Cess, may be forfeited. The policy also states that the bidder/allottee has to deposit applicable TDS separately with the Income Tax Department and can claim credit by submitting the required challan and TDS return.
How Can the Remaining Amount Be Paid?
The payment arrangement is different for SCOs and Clustered SCOs.
For SCO Sites
After the initial 25%, the remaining 75% can be paid in either of the ways provided under the policy. One option is lump-sum payment. The balance includes:
- 50% to be deposited within 90 days from issuance of the allotment letter.
- The remaining 10% to be deposited within 30 days from the offer of possession.
A 15% discount/rebate on the cost of the site is available for the eligible lump-sum payment arrangement, subject to the conditions and timelines mentioned in the policy. Alternatively, the balance 75% can be paid in 12 quarterly instalments with 12% annual interest.
For Clustered SCOs
The remaining 75% is payable in lump sum within 90 days from the date of issuance of the allotment letter. A 15% discount/rebate is available on lump-sum payment within the prescribed period. The policy also allows this period to be extended by another 30 days, making it up to 120 days, with 12% interest on the due amount.
What If You Delay Your Payments?
Payment deadlines are important. For SCO instalments, the policy provides for interest and additional penalty in case of delay. Depending on the length of the delay, the applicable rate can increase to 12% + 3%, 12% + 4% or 12% + 5%. If payments remain unpaid even after the permitted period, GMADA can initiate the process for resumption of the site under the applicable provisions of the Punjab Regional and Town Planning and Development Act, 1995. The policy also provides for forfeiture of 10% of the consideration money, interest and other applicable dues.
When Will Possession Be Given?
For an SCO, possession is to be given within 15 days of depositing the 75% amount, subject to the required Cancer Cess payment. For a Clustered SCO, possession is to be given within 15 days of full payment. The policy says that GMADA will not send a separate intimation for the possession date. It is the allottee's responsibility to obtain possession within the specified period.
Can the Site Be Transferred?
The rules are different for SCOs and Clustered SCOs. For an SCO, the allottee can transfer the site before the last instalment becomes due, but prior permission from the Estate Officer, GMADA, and applicable transfer fees are required. The entire site must be transferred; it cannot be transferred in parts. For a Clustered SCO, the site cannot be transferred before the full payment is made. After full payment and execution of the Conveyance Deed, transfer can be made with prior permission and payment of the prescribed processing fee. Mortgage of the site may also be permitted in the circumstances and with the permissions specified in the policy.
What Can You Build on the Site?
The site has to be used only for the purpose for which it is allotted. Change of land use is not permitted. The applicable building rules are the Punjab Urban Planning and Development Building Rules, 2021, as amended from time to time. Construction can begin only after the required building plans have been approved by the competent authority. For SCO sites, the building has to be constructed within 3 years from the date of the first allotment letter, subject to the extension provisions. For Clustered SCOs, the construction period is 5 years from the date of the first allotment letter, again subject to the applicable extension provisions. Before occupying the building, the allottee/transferee must obtain the required completion/occupation certificate.
A Few Rules Bidders Should Not Miss
The policy also contains several important conditions:
- Bids have to be submitted in ₹ per sq. metre.
- Joint bidding for SCO and Clustered SCOs is allowed.
- At least 2 bidders and 3 bids are required for a successful bid.
