Overview of the Notice

The Greater Mohali Area Development Authority (GMADA) issued a public notice for allottees of: Purab Premium Apartments, Sector 88, S.A.S. Nagar regarding transfer of maintenance responsibility to the apartment complex's: Residents Welfare Association (RWA) According to the notice, the RWA had been constituted on: 28 September 2022 and maintenance of the project was being handed over to it.

What Was Changing?

Until the handover, maintenance-related payments for the project were being dealt with through GMADA. With the RWA taking over maintenance, GMADA created a clear cut-off between: old maintenance dues payable to GMADA and: future maintenance dues payable to the RWA. That cut-off date was: 30 June 2023

Maintenance Dues Up to 30 June 2023

GMADA informed allottees that any maintenance amount due: up to 30 June 2023 had to be deposited with: GMADA This applied even if an allottee actually made the payment after 30 June 2023. This is one of the most important points in the notice.

What If Someone Paid the Old Dues After 30 June 2023?

The notice is clear that the date of payment did not change who should receive the money. For example, if an allottee had unpaid maintenance relating to a period before or up to: 30 June 2023 but paid it in July, August or later, that amount still belonged to: GMADA and not the RWA.

Maintenance From 1 July 2023 Onward

Maintenance becoming due from: 1 July 2023 was to be deposited with: Purab Premium Apartments RWA The notice provided an Axis Bank account for these payments. For security and accuracy, users should verify the current RWA payment details from the latest RWA/GMADA communication rather than relying on an old bank-account number published in a historical notice.

The Simple Cut-Off

For allottees, the notice can be understood like this: Up to 30 June 2023 → Pay GMADA From 1 July 2023 onward → Pay the RWA The important factor is the period for which maintenance is due, not simply the date on which the allottee makes the payment.

Example 1: Old Dues Paid Later

Suppose an allottee had unpaid maintenance for: January to June 2023 but decided to clear it in: August 2023 According to the notice, that amount should still have been deposited with: GMADA because the dues relate to a period ending before the cut-off.

Example 2: Maintenance for July 2023

If maintenance became due for: July 2023 that payment fell after the cut-off and was therefore to be paid to: the RWA rather than GMADA.

Example 3: Part Old and Part New Dues

If an allottee had outstanding amounts covering both: May–June 2023 and: July–August 2023 the payments would effectively fall into two different periods. The portion up to 30 June 2023 would belong to GMADA. The portion from 1 July 2023 onward would belong to the RWA.

Where Could Allottees Check Their GMADA Dues?

The notice stated that details of maintenance dues could be downloaded from: gmada.gov.in This was particularly important for allottees who were unsure about the amount outstanding up to 30 June 2023.

Does the Handover Cancel Earlier GMADA Dues?

No. The handover of maintenance responsibility did not wipe out or transfer previous unpaid maintenance liabilities. GMADA specifically instructed allottees to clear the dues attributable to the period up to: 30 June 2023 with GMADA itself.

Does the Notice Mean GMADA Transferred Ownership of Purab Premium Apartments?

No. This notice concerns: maintenance responsibility It should not be confused with:

  • transfer of ownership of the land;
  • transfer of title of individual apartments;
  • conveyance deeds;
  • common-area ownership;
  • completion of every pending project work; or
  • transfer of all statutory responsibilities.

The document specifically addresses the maintenance arrangement.

What Does RWA Handover Mean Practically?

For residents, the change meant that routine maintenance after the cut-off was to be managed through the Residents Welfare Association rather than through GMADA. However, this notice by itself does not specify the detailed scope of work transferred to the RWA. It does not list whether every individual service, repair or infrastructure item was included. Those details would require the actual handover documents or RWA records.

Was the RWA Newly Formed in July 2023?

No. The notice says the RWA had already been constituted on: 28 September 2022 The later notice concerns the handing over of maintenance responsibility to that already constituted association.

Why Is This Notice Still Useful for Owners?

The notice remains useful when resolving disputes about older maintenance payments. For example, an owner may need to establish whether a particular historical payment should have gone to:

  • GMADA; or
  • the RWA.

The answer depends primarily on the period for which that maintenance was payable.

If an Owner Is Buying a Resale Apartment Today

A buyer of a resale apartment in Purab Premium should not assume that an old maintenance balance belongs entirely to the present RWA. It can be useful to separate: pre-1 July 2023 dues from: post-1 July 2023 RWA dues. Before completing a resale, a buyer may wish to obtain:

  • GMADA dues status for the earlier period;
  • RWA maintenance statement for the later period;
  • payment receipts;
  • no-dues confirmation, where available; and
  • details of any disputed amount.

What If an Allottee Paid the Wrong Authority?

The notice itself does not explain the procedure for correcting a payment deposited with the wrong entity. An allottee facing such a situation would need to check the payment receipt and approach the concerned GMADA/RWA office for reconciliation. The historical notice alone should not be used to assume that a payment would automatically be transferred between GMADA and the RWA.

What This Notice Does Not Tell Us

The notice does not state:

  • the monthly maintenance rate;
  • apartment-type-wise charges;
  • arrears interest;
  • late-payment penalty;
  • RWA maintenance rate after 1 July 2023;
  • how disputes would be resolved;
  • whether any later maintenance rate was revised; or
  • the current RWA bank account.

Those matters require later records.

In Simple Words

Practical Takeaway

For any historical maintenance dispute at Purab Premium Apartments, remember one rule: Dues up to 30 June 2023 belonged to GMADA. Dues from 1 July 2023 onward belonged to the RWA. The date on which payment was actually made did not change the cut-off for the earlier GMADA dues.
