Overview of the Land Acquisition Notice
The Land Acquisition Collector, Urban Development Department, Punjab has issued a public notice regarding further action under Section 8 of the RFCTLARR Act, 2013 for the proposed acquisition of land for the Eco City-4 Residential Project in S.A.S. Nagar. The proposed acquisition covers land in the following villages:
- Boothgarh
- Rajgarh
- Kartarpur
- Kansala
The notice states that approximately 526.0355 acres of land is proposed to be acquired for the Eco City-4 Residential Scheme, including roads.
Social Impact Assessment for Eco City-4
A Social Impact Assessment (SIA) was conducted by Guru Nanak Dev University, Amritsar for the proposed acquisition. The SIA examined the likely social impact of acquiring land in Boothgarh, Rajgarh, Kartarpur and Kansala for the Eco City-4 project. After the SIA report was submitted, an Expert Group constituted under Section 7 of the RFCTLARR Act, 2013 reviewed the findings and provided its recommendations.
Expert Group Recommendations Accepted Under Section 8
The competent authority has now considered the Expert Group's recommendations under Section 8 of the RFCTLARR Act and has approved them. According to the notice, the government has decided that the proposed land acquisition may proceed further. The findings considered include that:
- the proposed acquisition serves a public purpose and acquisition of the land is considered necessary
- the expected benefits of the project are considered greater than the identified social costs and negative social impacts
- only the minimum land considered necessary for the project has been proposed for acquisition
- there is no previously acquired unutilised land available in the area for the project
- if any previously acquired land remains unused, it should be considered for an appropriate public-purpose use
Connection With the New Chandigarh Master Plan
The attached government communication states that the proposed Eco City-4 Residential Scheme is being taken forward in accordance with the New Chandigarh Master Plan. The proposed acquisition includes land required for the residential scheme as well as associated roads.
What Does Section 8 Mean?
Section 8 is an important decision-making stage in the land-acquisition process. At this stage, the competent authority considers:
- the Social Impact Assessment
- the Expert Group's recommendations
- whether the project serves a public purpose
- whether the benefits outweigh the social costs
- whether the proposed land requirement is limited to what is necessary
In this case, the competent authority has accepted the Expert Group's recommendations and decided that the acquisition process should proceed further. However, Section 8 approval does not mean that the entire land-acquisition process has been completed. Further statutory steps may still be required before an acquisition award, compensation and possession.
Why Has This Notice Been Issued?
The notice has been issued to disclose the Section 8 decision and Expert Group recommendations to affected families and residents. Copies have been sent to:
- Sub-Divisional Magistrate, Kharar
- Tehsildar, Kharar
- Sub-Tehsildar, Majri
- Sarpanches of Boothgarh, Rajgarh, Kartarpur and Kansala
- GMADA's IT Wing
- the concerned Housing and Urban Development Department office
Public Disclosure in the Villages
The Sarpanches of the four villages have been asked to arrange Munadi/public announcement regarding the notice. Copies of the notice are also to be displayed at prominent places such as:
- Temples
- Gurdwaras
- Mosques
- Community centres
- Janj Ghars
- Other public notice boards
The notice is also to be uploaded on GMADA's website.
What Happens Next?
Following the Section 8 approval, the proposed acquisition can proceed to further stages under the RFCTLARR Act. Affected landowners should continue to monitor subsequent notifications relating to:
- Khasra numbers
- exact land schedules
- further acquisition notifications
- hearings and claims
- compensation
- rehabilitation and resettlement
- land-pooling options (if applicable)
- acquisition awards
- possession
What Should Landowners Check?
Landowners in Boothgarh, Rajgarh, Kartarpur and Kansala should verify:
- Their Khasra number
- The exact area of land affected
- The official land schedule
- Subsequent notifications
- Hearing dates
- Compensation or land-pooling provisions
- Any amendment or court order affecting their land
The inclusion of a village in the notice does not automatically mean that every land parcel in that village is being acquired.
