Overview of the Office Order for House No HIG 687 in Sector 63 SAS Nagar

The Greater Mohali Area Development Authority (GMADA) has issued an office order regarding the restoration of the allotment of HIG House No. 687, Sector 63, S.A.S. Nagar. The house was originally allotted through Allotment Letter No. 23617 dated 12 December 1989. The allotment was later cancelled because the allottee did not deposit the house instalments on time. Following legal proceedings, including a decision by the Hon'ble Punjab and Haryana High Court, GMADA has now cancelled the earlier cancellation order and restored the allotment of the house.

Why Was the Allotment Cancelled?

According to the office order, the allottee failed to deposit the house instalments within the required time. GMADA issued show-cause notices and hearing notices to the allottee. However, the instalments were still not deposited. As a result, GMADA issued Office Letter No. 1765-67 dated 6 January 1994, cancelling the allotment of the house and forfeiting the amount that had been deposited.

Appeal Against the Cancellation

The allottee challenged the cancellation order by filing an appeal before the Chief Administrator-cum-Appellate Authority. The appeal was dismissed through orders dated 1 December 2014. The allottee then filed a revision petition before the Revisional Authority-cum-Special Secretary, Department of Housing and Urban Development. This revision petition was also dismissed through orders dated 18 February 2016.

Matter Taken to the High Court

After the appeal and revision were dismissed, the allottee approached the Hon'ble High Court through CWP No. 11011 of 2016, Sushil Kumar Aggarwal vs. State of Punjab and Others. The High Court set aside the cancellation order in view of the circumstances of the case. The order noted that the amount had been deposited and that the respondents had continued to accept payments despite the cancellation, up to the year 2012. The Court also stated that if GMADA was entitled to recover any interest or penalty because of delayed payments or defaults, it could initiate the appropriate process for such recovery.

GMADA's Decision After Legal Opinion

After the High Court's decision, GMADA obtained a legal opinion regarding the matter. The Legal Branch reported that there were no strong grounds to challenge the judgment and that the High Court's decision should therefore be implemented. The legal opinion also noted that GMADA could recover applicable interest or penalty, as permitted by the Court's order. Considering the court judgment and the legal opinion, GMADA has decided to cancel the earlier cancellation order dated 6 January 1994. As a result, the allotment of HIG House No. 687, Sector 63, S.A.S. Nagar, has been restored.

What the Order Means

The office order restores the original allotment of the house following the directions of the High Court. However, the High Court's order allowed the concerned authority to initiate proceedings for recovery of interest or penalty if applicable due to delayed payments or defaults.
